There is more to being a drone pilot than just buying a machine and flying in your backyard. It can be that simple, but most of us will need to understand some drone laws before we try to take to the sky.
When I got my first drone, I immediately took it outside and took to the sky. Moments later I was rescuing it from a tree. I’ve learned a lot since then, logging many hours of flight and acquiring my Part 107 license, that’s the FAA’s Remote Pilot Certificate with a sUAS rating. While you may not need your commercial drone pilot’s license, you’ll at least need to get your TRUST certification before you fly in the United States.
Your pilot journey may be different than mine, but most countries have rules to follow, and a few basic guidelines to help you fly safely. That’s all we want for you as well, to be able to fly safely, legally, and still have fun.
TRUST certificate required for all hobby pilots
First and foremost, if you plan to fly in the United States, you must take a short course and pass a test. TRUST, which stands for The Recreational UAV Safety Test, is mostly designed to be about safety education for new pilots.
TRUST is free, you can take it online, and it should only take about an hour of your time.
The FAA has not specified when it will start cracking down on unlicensed pilots, but the requirement to acquire your certificate was instated on June 21, 2021.
Like it or not, if your drone weighs more than 0.55 lbs at take-off, you need to have an FAA registration number attached to the craft. This is for the United States, obviously, but many countries around the globe have similar requirements. Bottom line, there are laws that you are going to need to know and follow for your flight.

You must display your drone registration number on the outside of your craft.
The FAA enacted a new drone law for you to be aware of, it’s simple, you already had to keep your FAA registration number with your drone, now you must ensure that it is externally visible on your craft whenever it is in the air. You can put a label, write it on with a marker or etch it into the body of the drone, there is no rule on how you affix it, just that it needs to be there.

The FAA has explained that all drones will soon need an active Remote ID transmitter before taking off. The effective dates, and the exact technology required, are still undetermined. Click that link above in this paragraph for what we know so far. The short version is that by 2023 there will be very few circumstances that allow you to fly without a transmitter. Your current drone will need to be upgraded, have an external transmitter attached, or you’ll have to retire it from outdoor flight.

Let me be plainly clear here, I had a long chat with some representatives from the FAA recently. This was ‘off the record’ in that I am free to speak of the conversation, but these are not official rules or guidelines from the FAA. This is advice, not law:
The need for Part 107 certification is growing – even for hobby pilots
Do you intend to make any money at all from your drone flight, including the images and video you capture from the sky? Some examples you may not have thought of include posting your fun video on YouTube with monetization turned on, flying in a race that has a prize winning, or even accepting a hot dog as a thank you for showing the neighbor kid how to fly at a casual afternoon BBQ. I was asking for clarification on flights such as these, the FAA rep made it clear, if your flight will be compensated in any way, shape or form, it should be managed as a commercial flight.
That’s right, viewing the laws literally, you need your Part 107 certification to fly in most of the situations that we take for granted.
They could not comment on whether or not the FAA would be stepping up policing of drone flights, but there are drone registry and identification measures in the works. With an identification system in place, such as DJI’s AeroScope platform, law enforcement on the ground would be able to identify a pilot from the craft in the sky. We hope that hobby flights can continue as they have for years, but I urge you to consider the ramifications if you are making money off of your drone activities. Like it or not, we are going to have to follow these ever narrowing guidelines for the sky.
February 2019 – All drones must externally display your FAA registration number.
May 2019 – All hobby flights within controlled airspace (such as around airports) require authorization before you can fly. Your backyard may now be a no-fly-zone!
July 2020 – All pilots require a TRUST certificate (drone license) before they fly a hobby drone.

Let’s make this painfully clear, folks, if you will be receiving compensation for your flight in any way, you must hold a commercial drone pilot license. You can fly for fun all day long, but if you are planning to capture media from the sky that you will be paid for, it is illegal to do so without your Part 107 certificate over American soil.

Selling your photos or videos on sales platforms such as Shutterstock is considered direct compensation for your flight, you’ll need your Part 107 commercial drone license to do this legally. The FAA requires you to renew your Part 107 Remote Pilot Certificate every two years. This requires you to retake the full Part 107 exam every 24 months. Frequently Asked Questions
Are there any training classes for how to fly a drone, not just for the Part 107?
There certainly are. This is why we recommend Drone Pilot Ground School, they offer a well supported Part 107 training program, as well as many extra classes on how to get the most out of your drone. There is still little substitute for getting out there and practicing with your own machine, but there are these classes and others that can assist along the way.
Do I have to take classes before I become a drone pilot?
No, there are no mandatory classes of any sort as pertains to sUAS (small Unmanned Aerial Systems) in the United States. You need to read the laws and rules before you take of for hobby purposes, and you’ll need to read the training materials before you attempt to write your Part 107 so you can fly for pay, but the FAA does not enforce how you gain the knowledge, as long as you can prove you are flying safely and legally.
Did that one pilot really get charged $182,000.00 by the FAA?
It is true that the FAA can and will charge you with a separate fine for every infraction you make with your drone. The core rules violated in the referenced case were flying over top of people, flying in no-fly zones, flying in controlled airspace without LAANC authorization, flying beyond visual line of site, flying for pay without Part 107 certification, and more, that totals up to well over twenty individual violations, for roughly a $7000 fine per violation. Please, folks, I know the rules can suck sometimes, but please follow them. Not only to save your wallet some grief, but the better we are in the sky, the fewer new rules the FAA will need to force on us in the future.
